Definitions
Seller - shall be understood as Antoni Jan Gawiński running a business under the business name of PRZEDSIĘBIORSTWO DRZEWNE "JAWOR" ANTONI

Customer - a natural person with at least limited capacity for acts in law and over 18 years of age, as well as a legal person or an entity that is not a legal person, but to which special laws grant legal capacity and the capacity for acts in law, who makes an Order at the Store;
Civil Code – the Act of 23 April 1964 - the Civil Code (Journal of Laws no. 16 item 93 as amended);

Online Store (hereinafter referred to as the Store) – online stores run by the Seller at www.jawor-parkiet.com

where the Customer places their orders or makes their inquiries;
Goods - all products and services offered at the Store by the Seller;
Sales Agreement - an agreement for sale of Goods as defined by the Civil Code, concluded between the Store and the Customer (using the website - the Store);
Consumer Rights Act - the Act of 30 May 2014 on Consumer Rights (Journal of Laws of 2014 item 827), which contains information on consumer rights;
Act on Providing Services by Electronic Means - the Act of 18 July 2002 on Providing Services by Electronic Means (Journal of Laws no. 144 item 1204 as amended), which contains information on electronically provided services;
Order - Customer's declaration of intent, aimed directly at the conclusion of the Sales Agreement (specifying the type and number of the Goods);
Presumed completion date - Sales Agreement completion date specified by the Seller on a case-by-case basis;
If the nature of the Agreement's subject matter makes it reasonably impossible to calculate the end (final) price in advance, information about how the price will be calculated, as well as information about fees for transport, delivery, courier services and other costs, will be specified in the Product's description at the Store.
The Store's offer is valid only in Poland. All agreements concluded through the Store are made in the Polish language only.
The Seller reserves that the dimensions indicated at the Store's website are provided in millimeters, with a tolerance of approx. +/- 2% of a given dimension.
"Superpromo" products are promotional or sale products whose price remains valid and availability is limited until the end of the promotion or until the current stocks are exhausted. This means that if a product at a discounted price is no longer available, the Customer is not entitled to a discount on the same product from the new delivery, nor compensation if the product is out of stock.
Interested Party - a natural person with at least limited capacity for acts in law and over 18 years of age, as well as a legal person or an entity that is not a legal person, but to which special laws grant legal capacity and the capacity for acts in law, who makes an inquiry concerning the "Superpromo" offer;
General provisions
These Regulations set forth the rules for making inquiries, cooperation and product purchases;
These Regulations constitute the regulations as defined by Article 8 of the Act on Providing Services by Electronic Means.

By placing an order, the Customer accepts the terms and conditions contained herein;
Orders can be placed 24 hours a day, 7 days a week throughout the year. The company reserves the right to introduce restrictions in this aspect, in the form of possible maintenance breaks resulting from website updates. An order can only be placed using a device with access to the Internet;
Information, drawings, photos, images, illustrations, technical data, descriptions of weight, dimensions and durability, which are provided on the Seller's websites are of informative nature only. Due to the nature of the custom-made goods, we do not guarantee their consistency.
The information referred to in Article 12(1) of the Consumer Rights Act of 30 May 2014 will be sent to the Customer in an order confirmation e-mail at the e-mail address provided by the Customer when placing an order.

The Customer may contact the Seller using the addresses and phone numbers provided herein.
The Customer may contact the Seller by phone from Monday to Friday between 9 a.m. and 5 p.m.
Rules for placing custom orders
Payments made by the Customer under the Sales Agreement can be effected using the following methods:
Cash on delivery - payment is made in cash to a courier upon receipt of the goods. In the case of orders made at the e-store, the Seller has the right to require payment of a deposit in the amount specified individually to bank account PL81948411500000608720000067. The Customer is obligated to pay the remaining amount when collecting the goods;
Payment by bank transfer to the Seller's bank account;
The order processing time is counted from the moment of crediting the amount due to the account of the Seller, and in the case of choosing cash on delivery as a payment method, from the moment of paying a deposit, if required. If a deposit is not required, the order processing time is counted from the first working day following the order date.
The order processing time ranges from 2 to 10 working days. If delivery of the ordered Goods takes more than 10 working days, the Seller will notify this fact to the Buyer, and the Buyer will also be informed about the planned delivery date via e-mail or by phone.
The order processing time differs depending on the Goods and ranges from 2 to 10 working days. If this time is extended for reasons beyond the control of the Seller, the Buyer will be immediately notified of the possible extension by e-mail or phone.
In the case of custom-made Goods, the order processing time depends on the time necessary to manufacture the Goods as specified by the Customer. The Customer will be notified thereof via e-mail.
The Customer should read and accept these Regulations, which they confirm by confirming the Order;
By paying a deposit the Customer guarantees to conclude a final purchase - sale agreement. The amount of a deposit will be each time specified by the Seller. The Seller reserves the right to change the amount of the deposit for a given order at any stage of order processing;
If the Seller fails to perform an agreement, they will return twice the amount of the deposit to the Buyer. If the Buyer fails to perform an agreement, the Seller will have the right to retain the deposit.
Order processing and goods shipment.
The Seller is obligated to deliver the Goods being the subject matter of the Sales Agreement without defects;
The product may contain manufacturing errors that do not affect its quality and safety.
The Customer is aware of the fact that the colors of the product shown in the picture may differ from those in reality. The manufacturer is not responsible for screen settings.
Orders are processed on working days from Monday to Friday, therefore, Saturdays and public holidays are not included in the order processing time;
The Customer is aware that the order processing time may be extended for reasons attributable to the Seller, as well as for objective reasons, of which they will be personally notified.
The cost of shipment is paid by the Buyer as per the Store's price list. In the case of shipment outside the Republic of Poland, this cost will be calculated by the Store on a case-by-case basis;
Delivery of purchased Products is made by sending the Goods by carrier to the address provided by the Customer.
Delivery of the Goods does not include bringing the Goods inside the house.
If the Customer fails to collect the delivery, the next delivery will be charged with the fees payable by the Customer, who will be so notified by the Seller.
If the Customer misses two deliveries, the Seller will charge them with the costs of storage of the ordered Product.
Upon collection of the package, the Buyer should pay particular attention to its condition. In the case of visible damage, the Buyer draws up a report in the presence of a courier. If no report is drawn up, a complaint concerning the damaged package will not be processed.
A delivery may be delayed for reasons beyond the control of the Seller.
Rules for making a purchase at the Store.
In order to conclude a Sales Agreement via the Store, it is necessary to enter the Store's website, make a selection by taking technical steps on the basis of messages displayed to the Customer and information available on the website;
An order will be sent once the Regulations are accepted and personal data provided;
Information about the Goods placed at the Store's website does not constitute an offer as defined by Article 66 of the Civil Code. It constitutes an invitation to submit offers by Customers.
Placing an Order by the Customer constitutes a declaration of intent to conclude a Sales Agreement with the Seller as per these Regulations.
Delivery of purchased Products is made by sending the Goods by carrier to the address provided by the Customer.
The Seller is obligated to deliver the Goods being the subject matter of the Sales Agreement without defects;
Orders are processed on working days from Monday to Friday;
In exceptional cases, the order processing time may be extended, of which the Buyer will be personally notified;
The cost of shipment is paid by the Buyer as per the Store's price list. In the case of shipment outside the Republic of Poland, this cost will be calculated on a case-by-case basis;
The Customer may make a payment to the Store's bank account.
Delivery of custom orders and goods from the Store. Service available only in territory of Republic of Poland
Delivery of ordered Goods is made using:
- courier services or Poczta Polska [Polish Postal Service]
Right to rescind the agreement
Subject to clause 5, the Customer has the right to rescind the Sales Agreement within 14 days without providing any reasons. The time limit to rescind the Agreement ends after 14 days from the date on which the Customer came into possession of the item or on which the third party named by the Customer other than a carrier came into possession of the item.
Once rescinded, the Agreement will be considered not concluded;
Direct costs of returning the Goods shall be borne by the Customer. The Seller shall bear the costs of returning the Goods only if they have previously agreed to incur other than direct costs of returning the Goods;
If the Goods purchased at the Store are defective, the Customer has the right to make a complaint based on the Civil Code provisions concerning express warranty;
To exercise the right of rescission or complaint, the Customer must submit to the Seller a declaration of rescission of the agreement by traditional mail or electronically to the address indicated above.
The Customer agrees to send back or deliver the Goods to the Seller's address immediately, not later than 14 days of informing the Seller about rescinding the agreement. The above deadline is met if the Customer sends back the Goods before the 14-day term expires. The Seller will reimburse the Customer for the returned Goods within 7 working days, counting from the submission of the declaration of rescission of the Sales Agreement to the Seller. The Seller may withhold reimbursing the Customer until receipt of the returned Goods or a proof of returning the Goods by the Customer.
The consumer does not have the right to rescind the agreement in cases specified in detail in Article 38(1) of the Act of 30 May 2014 on Consumer Rights, among others, with respect to agreements:
whose subject matter is an item delivered in a sealed package that cannot be returned after opening the package for health protection or hygiene reasons, if the package has been opened after delivery.
Free samples of Jawor-Parkiet floors – service available only in territory of Republic of Poland
The Seller may offer the opportunity to order free floor samples of selected products.
The Seller specifies the maximum number of floor samples (6 samples per household/entity) that the Customer can receive.
The Seller may temporarily or permanently disable the option to order free samples of a particular floor, as well as refuse to send free samples depending on the availability of the material and its finish, change in company policy or other circumstances.
The samples do not constitute a color chart. Wood is a naturally unique material; therefore, the samples are for illustrative purposes only. The actual appearance and colors of ordered floors may differ.
Shipping of samples within Poland takes place at the Seller's expense.
The order processing time ranges from 2 to 10 working days, depending on the floor's availability.
SuperPromo - service available only in territory of Republic of Poland
The Seller offers the Interested Party the opportunity to make an inquiry about the "Superpromo" offer at the Store's website.
To use the "Superpromo" option, the Interested Party should make a choice from among the goods available under the "Superpromo" tab, fill in a contact form and make an inquiry, which will then be forwarded to one of the Seller's distributors.
Upon receipt of an inquiry, the assigned Seller's distributor will contact the Interested Party to provide an offer and enter into a sales agreement.
Submitting an inquiry for the "Superpromo" offer does not constitute purchase or reservation of the selected floor.
Privacy policy and personal data safety
The Controller of databases of personal data submitted by the Store's Customers is the Seller;
By placing an order, the Customer agrees to the processing of his or her personal data for the purpose of carrying out the order, providing electronic services by the Seller and other purposes specified in the Regulations (in accordance with the Act of 29 August 1997 on the Protection of Personal Data; uniform text: Journal of Laws of 2002 no. 101 item 926 as amended) and the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (Official Journal of the European Union no. 119 page 1) ("Regulation");
Personal data is provided by the Customer on a voluntary basis;
The Customer consents to the transfer of his or her personal data to the Supplier to the extent necessary to carry out the Delivery;
The Customer may at any time change their personal data or withdraw consent to their processing, by submitting an appropriate Declaration. The Declaration may, for example, be sent to the Seller's address via e-mail.
Personal data will be stored for the period necessary to complete the transaction at the Store and process the complaint. They will be processed for a period of 3 years from the date of the transaction. In the case of processing personal data for legitimate purposes of the Seller, data are stored for the time of said purposes’ implementation and on the basis of the Customer's consent - data are stored until the consent is withdrawn.
The Customer has the right to lodge a complaint to the President of the Personal Data Protection Office (and before this office was established - to the Inspector General for Personal Data Protection) if he or she considers that the processing of their personal data violates the law.
Final provisions
The Seller reserves the right to amend these Regulations for important reasons, such as: changes in the law, changes in methods of payment and delivery - to the extent that these changes affect the implementation of the provisions of these Regulations.
To matters unsettled herein, the generally applicable provisions of the Polish law shall apply, including specifically: the Civil Code; the Act on Providing Services by Electronic Means; the Consumer Rights Act; the Personal Data Protection Act. The provisions of these Regulations do not affect the consumer's rights resulting from the agreement in the event of non-compliance therewith or from the warranty. The provisions of these Regulations shall be interpreted in a manner ensuring their compliance with the applicable law.
These Regulations becomes effective once they are published at the Store's website.
